Terms of Use
We look forward to welcoming you to Kelp Cottage self-catering, North Uist and ask that you kindly read our terms of use prior to making your booking. Please be advised that the house is only available for families and couples.
Bookings
Prior to booking we strongly recommend that you check availability of your travel plans before booking your accommodation, through CalMac or flight timetables as these routes can be very busy throughout the year and especially in the summer months. The timetables are available as follows www.calmac.co.uk or www.loganair.co.uk. The property is on an island and as such travel by ferry/plane is essential. Any transport disruptions are out with our control, and we cannot be held responsible for non or late arrival and no refund will be given.
The Contract for a short-term holiday rental will be between us, the owners of Kelp Cottage self-catering, North Uist and the person making the booking and under the following booking conditions. These must be complied with. As the person making the booking, you are responsible for ensuring all members of your booking party comply with the Terms of Use which are set out below.
The agreement to stay in the property for the holiday period does not create the relationship of Landlord and Tenant between the parties. The maximum number of people entitled to stay at this property is 6. Only those people named on the booking form are entitled to stay. Families with children are most welcome but children must be supervised at all times.
If it is found that more people than agreed are using the property, this will be considered a breach of contract and the holidaymaker and his/her party will be asked to leave immediately without any refund. Sub letting or assignation of the let is prohibited. You agree to use the property solely for its intended purpose as self-catering holiday accommodation.
BBQ areas
In addition to the patio at the rear of the cottage, we have a summerhouse in the garden which has its own patio area. Both are ideas for having a BBQ. We ask that you only use the picnic / BBQ plates, glasses etc provided for use in the garden to reduce the risk of breakages and injury. BBQ’s MUST be situated on the concrete areas. Absolutely no BBQ cooking on the grass or within planted areas.
Smoking & Pets
Absolutely no smoking within Kelp Cottage or the summerhouse. An additional cleaning fee will be charged if smoking occurs in the property.
If you have a registered Guide Dog, please email us to discuss your requirements prior to booking. Strictly only registered guide dogs by prior arrangement and no other pets of any description will be allowed in the property.
Payment
Bookings made less than 8 weeks prior to the arrival date must be paid in full at the time of booking. Bookings made more than 8 weeks in advance of arrival can be secured with a 30% deposit, with the balance being paid no later than 8 weeks prior to the start of the rental period. Failure to pay the balance will be considered a cancellation by you and as such no refund will be applied.
Payment can be made by bank transfer or through our online payment system. Only on receipt of the full balance of payment will we send you details about your arrival and accessing Kelp Cottage self-catering, North Uist.
The following are included for use for the duration of your booking. All linen and towels are provided, heating (oil & electric) and wireless internet access. Fortnightly or longer stays include a weekly clean and linen change.
Your use of the property does not entitle you to charge an EV or appliances other than personal electronic devices such as phones, tablets or laptops. If you have particular charging requirements, please get in touch before your stay and we can advise of EV charging points.
Cancellation by the Holidaymaker
If a booking is made in error, we will honour your cancellation with a full refund of money paid within 5 days of having made the original booking. To cancel a booking in this circumstance, please notify us immediately by email to [email protected]
In the event of a cancellation after 5 days, we will endeavour to re-let the property. If successfully re-let, you will be reimbursed the cost of the rental minus the 30% deposit. If we are unable to re-let, the full cost of rental (deposit plus full balance) will be retained.
We strongly advise that you take out UK travel insurance to cover these eventualities. If you choose not to take out UK travel insurance then you accept responsibility for any loss that you may incur due to your cancellation. Any refunds will be made by the checkout day of your original booking.
House unavailability & cancellation by owner
We will endeavour to make sure Kelp Cottage self-catering, North Uist is available for the dates contracted in your booking. In the unlikely event the property becomes unavailable, we, as the property owners have the right to cancel the booking. In this circumstance, we will endeavour to find you, the holidaymaker, suitable alternative accommodation. If suitable alternative accommodation cannot be found, you will be entitled to a full refund. We will only be liable to return the monies received for booking. No compensation or consequential losses shall be paid.
Insurance & Liability
You are advised to take out holiday insurance to minimise the cost and inconvenience of cancelled or curtailed bookings and to cover loss or damage to personal belongings. The property owner takes no responsibility for the personal possessions of the holidaymaker or the holidaymaker’s party. Vehicles and possessions are left entirely at the risk of the holidaymaker.
Access and maintenance
As the property owner, we reserve the right to enter the property (house and garden), at a reasonable time, in the event of an emergency or remedial repair work being required. Please be aware that garden maintenance will be essential during your stay. Kelp Cottage self-catering North Uist has a large established garden and needs weekly upkeep. We aim to undertake gardening work during the day and where possible while you are out enjoying touring the island. Any evening access to the garden will be discussed and agreed with you.
Breach of contract
We reserve the right to ask the holidaymaker and their party to leave the property, without refund, should the behaviour of the holidaymaker and/or their party be considered by us, the property owner to be unreasonable of if any of the terms of use have been broken.
Cleaning
We would like to think the holidaymaker and party would treat the property as they would their own home and at the end of the holiday the property is left in a clean and tidy condition. The property owner retains the right to make an additional charge for cleaning should the property not be left in a similar condition to the way it was found at the start of the holiday.
Breakages
We have spent a great deal of time and care in preparing Kelp Cottage self-catering, North Uist as a short-term rental destination. We ask in return, that you make every effort to keep the property, fixtures and fittings and all contents in the same state of repair and condition as at the start of your holiday. Any accidental damage or breakages should be reported to us, prior to departure. We retain the right to make an additional charge for damage and breakages should it be apparent that it is not that wear and tear.
Arrival and Departure Time
We will make every effort to have the property available from 16:00 on the day of arrival. The property must be vacated by 10:00 on the day of departure. Late departure will result in an additional charge being made. Information about access and keys and how to collect them will be provided once full payment has been received.
You should not arrive before 4pm on arrival day, and you should leave by 10am on departure day unless otherwise advised. Failure to do so may result in you being charged a further day’s rental.
Problems arising during your stay
Every effort has been made to ensure that you have an enjoyable stay. However if you have any problem or cause for complaint, it is essential that you contact us immediately on [email protected] and we will do our best to resolve any issues as soon as we can.
